THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.43723 OF 2018 ORDER:

The present Writ Petition came to be filed seeking to declare the action of the 2nd respondent in not considering the representations dated 23.4.2018 and 30.4.2018, submitted by the petitioners requesting the 2nd respondent, to issue Transfer of Development Rights Certificate (TDR Certificate) in favour of the petitioners for acquiring the site to an extent of 500 sq. yards each, situated at Sy.No.205 of Madhurawada Village and Mandal, Visakhapatnam District, for the purpose of road widening, as illegal and arbitrary.

Sri S. Lakshminarayana Reddy, learned Standing Counsel for the 2nd respondent, would submit that the representations of the petitioner shall be examined as to the extent of the land to which the petitioners are entitled for issuance of the T.D.R Certificates and then steps will be taken, in accordance with law, at the earliest. The same is not seriously disputed by the learned counsel for the petitioners.

Having regard to the above, the writ petition is disposed of directing the 2nd respondent, to deal with the representation dated 30.04.2018, submitted by the petitioners requesting the 2nd respondent, to issue Transfer of Development Rights Certificate (TDR Certificate), in favour of the petitioners for acquiring the subject property for the purpose of road widening, and pass appropriate orders, in accordance with law, as early as possible after giving reasonable opportunity of hearing to the petitioners and all concerned. No order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
