THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO TRANSFER CRIMINAL PETITION No.225 OF 2017 ORDER:

The only allegation is the officer dismissed the application for recall of the witness sought in the summary trial case sustainable under Section 138 N.I.Act and the further allegation is the officer stated that the evidence is enough to convict the accused and it is a prejudice. 2.

This Court is not seeing the same as a ground, but for to observe, while disposing of the application for nothing to transfer, the officer shall exercise judicial restraint and dispose of uninfluenced by any comments earlier made or any allegations made in the transfer petition but for within the judicial wisdom.

Accordingly and with the above observation, this criminal petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
