THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.10185 OF 2017 ORDER:
This criminal petition is filed under Section 482 Cr.P.C to quash the proceedings in Crime No.198 of 2017 on the file of Manchal Police Station, Rachakonda District, registered for the offences punishable under Section 174 Cr.P.C. The main contention of the learned counsel for the petitioner is that the report lodged with the police does not disclose commission of offence punishable under the provisions of SC/ST (POA) Act. Whereas, there is a considerable change in the version of the defacto complainant that the allegations to attract the provisions of SC/ST (POA) Act.
The only contention of the learned counsel for the petitioner is that there is a bar under Section 18 of SC/ST (POA) Act to grant pre-arrest bail and the petitioner is apprehending their arrest in connection with the non-bailalbe offence, requeste to issue direction to decide the application if any filed under Section 439 of Cr.P.C.
In view of the submissions made by the learned counsel for the petitioner, I deem it appropriate to direct the Special Judge for Trial of offences under the Scheduled Casts and Scheduled Tribes (Prevention of Atrocities) Act, Ranga Reddy District, to dispose of the application, if any filed under Section 439 Cr.P.C by the petitioner for grant of regular bail, after serving notice on the
MSM,J Crlp_10185_2017 learned Public Prosecutor in advance and dispose of the application on the same day, in accordance with law. With the above direction, the criminal petition is disposed of. Consequently, miscellaneous applications pending if any, shall also stand closed. No costs.
