THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD CI VI L MI SCELLAENOUS APPEAL NO.1007 of 2016 JUDGMENT: (per SK,J) Ms.K.Kiranmayee, learned counsel representing Mr.K.Rama Mohan, learned counsel for the appellant, states that the cause in this appeal no longer survives for consideration on merits.

Recording the said statement, the Civil Miscellaneous Appeal is dismissed as infructuous.

However, as Ms.K.Kiranmayee, learned counsel, would state that liberty may be given to the appellant to file a fresh case in the event the suit is restored to file, we grant such liberty. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
