In all these writ petitions, the petitioners are challenging the order passed by the 4th respondent rejecting their case for grant of pattadar passbooks and title deeds in respect of subject lands. In view of the same, these writ petitions are being disposed of by way of common order.

Learned counsel for the petitioners submits that subject lands situated at Chinnachowk Village, Kadapa District were purchased through bank auction, as such the same were registered in the name of petitioners and their vendors purchased the same through registered sale deeds. Without considering the said aspects and without recording any reasons, the impugned orders are passed.

Learned Assistant Government Pleader for Revenue produced written instructions stating that subject lands are in the prohibited list. It is also stated that though the applications of the petitioners were rejected stating that subject lands were resumed prior to conducting of auction. But the impugned orders do not contain all those details. More so, reasons in support of impugned orders cannot be supplemented by way of filing affidavit or otherwise. Since the impugned orders are bereft of reasons and since the petitioners assert that subject lands are purchased through bank auctions and registered sale deeds have been executed, the 4th

respondent is obligated to consider the said aspect while passing the orders on the applications of the petitioners. In view of the same, the impugned orders are set aside. The 4th respondent is directed to issue notice to the petitioners and after affording opportunity of hearing to them, pass appropriate orders on the applications of the petitioners, in accordance with law. It is open for the petitioners to produce necessary documents before the 4th respondent and he shall consider the same while passing the orders.

Accordingly, these writ petitions are allowed to the extent indicated above. As a sequel to the disposal of these petitions, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 03-12-2018 Nvl
