HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.20124 OF 2016 ORDER:

The case of the petitioner is that he is the absolute owner of the property in Sy.No.43 A & B admeasuring Ac.4-27 guntas aituated at Kandlakoi Village and Gram Panchayat, Medchal Mandal, Ranga Reddy District having purchased the same by virtue of registered partition deed dated 30.03.1995 vide Doc.No.4414 of 1995. Out of the total area, an extent of Ac.4-22 guntas has been sold to M/s Shanta Sriram Housing Pvt. Ltd through registered agreement of sale cum GPA. Remaining Ac.0-5 guntas of land is affected in Outer Ring Road Project. In view of the same, petitioner made representation dated 15.03.2014, requesting the authorities to conduct survey and pay the compensation. Since no action has been initiated by the 2nd and 3rd respondents, petitioner again made representations dated 18.11.2015 and 20.05.2016.

In response to the same, the 2nd respondent addressed a letter dated 17.04.2015 to the Estate Officer, HMDA stating that an excess area has been affected during the formation of out ring road, which is not part of notification and the Estate Officer in turn addressed a letter to the 2nd respondent requesting to send necessary information for further course of action. But the respondents 2 and 3 failed to examine the matter and take appropriate action on the representations made by the petitioner. Aggrieved by the same, the present writ petition is filed.

Heard the learned counsel for the petitioner, learned Assistant Government Pleader for Land Acquisition for 1st respondent and Sri E. Madan Maohan Rao for respondents 2 and 3.

In the present case, even the letter addressed by the 2nd respondent on 17.04.2015 goes to show that the representations made by the petitioner are pending.

In view of the same, the respondents are directed to dispose of the representations made by the petitioner on 15.03.2015, 18.11.2015 and 20.05.2015 by taking into account the letter addressed by the 2nd respondent on 17.04.2015 in accordance with law and thereafter take appropriate action. With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
