HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.43793 of 2018 ORDER:
This writ petition is filed challenging the action of the 3rd respondent in not registering the document presented by the petitioner in respect of property to an extent of 1448.7 sq.yards in Survey No.212/1, situated at Donakonda Village and Mandal, Prakasam District, by assigning pending document No.7/2018, dated 30.01.2018.
Learned Counsel for the petitioner submits that though petitioner has paid the entire sale consideration by paying the requisite stamp duty and filed all relevant documents on 30.01.2018, and though the subject property is not included in the list of prohibited properties under Section 22-A of the Registration Act, the 3rd respondent has kept the same as pending by assigning Pending Document No.7 of 2018. He also submits that nearly ten months time elapsed, but the 3rd respondent has neither registered nor refused the document presented by the petitioner, which is pending. Heard learned Assistant Government Pleader for Revenue.
In view of the aforesaid facts and circumstances, the 3rd respondent is directed to register the document presented by the petitioner in respect of the subject land, if the same is in order as per the provisions of Indian Stamps and Registration
Act and the Rules made thereunder, and if the subject land is not included in the list of prohibited properties for registration as per Section 22-A of the Act or not prohibited for registration by any order/injunction passed by the Court or competent authority. If he wants to refuse registration, he shall record reasons and communicate the same to the parties.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any pending, in this writ petition shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 04.12.2018 tk
