THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CRIMINAL PETITION No.10726 of 2017 ORDER:
By the order, dated 28.03.2017, in Crl.M.P.No.861 of 2017 in Cr.No.348 of 2015 of Chandrayangutta Police Station , the learned Chief Metropolitan Magistrate, Hyderabad, dismissed the petition filed under Section 451 of the Code of Criminal Procedure, for granting interim custody of Innova vehicle bearing No. AP 28 DW 2499, on the ground that the material object, which is said to be involved in the present crime registered for the offence punishable under Section 302 IPC, was not yet produced.
In the present Criminal Petition, though, Smt. Thakur Roopa Singh, learned counsel for Sri A. Ravi Shankar, learned counsel for the petitioner, initially, intended to get the aforesaid order set aside, but, however, would make a request to direct the police concerned to deposit the vehicle with the Court.
As the crime relates to the year 2015 and two years already elapsed, acceding to the request of learned counsel for the petitioner, respondent No.1 is directed to produce the vehicle bearing No. AP 28 DW 2499 before the learned Chief Metropolitan Magistrate, Hyderabad, as expeditiously as possible, as it is stated that the other material objects were already deposited with the Court.
The Criminal Petition is, accordingly, disposed of at the admission stage itself.
Miscellaneous applications, if any, pending in the Criminal Petition stand closed.
