THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11042 OF 2017 ORDER:

Heard learned counsel for the petitioner/A.6 and learned Additional Public Prosecutor for the respondent State, and perused the record.

This petition is filed under Section 439 Cr.P.C. for grant of bail to the petitioner/A.6 in Crime No.292 of 2016 of Nalgonda II Town Police Station, Nalgonda District for the offences punishable under Section 420 IPC, Section 12 of Passport Act, 1967 and Section 14(A)(B) of Foreigners (Amendment) Act, 2004. Learned counsel for the petitioner would submit that the petitioner is falsely implicated in this case and ultimately prayed to allow the petition.

It is brought to the notice of this Court that the charge sheet is filed. It is mentioned that the petitioner is a foreigner. In the event of the petitioner releasing on bail in this case, it is not possible to apprehend him again. Under these circumstances, it is not a fit case to allow the petition. However, the trial Court can be directed to expedite the trial.

In the result, the Criminal Petition is dismissed. The trial Court is directed to complete the trial of this case within three months from the date of this order.
