HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.20246 OF 2016 ORDER:
The case of the petitioner is that he is the absolute owner of the of the plots bearing Nos.105/P; 106 and 107, admeasuring total extent of 563 sq.yards situated at Kandlakoi Village and Gram Panchayat, Medchal Mandal, Ranga Reddy District having purchased the same by virtue of registered partition deed dated 20.12.2004 vide Doc.No.16931 of 2004. While so, the respondents 2 and 3 issued notification dated 08.07.2005 under Section 4(1) of the Land Acquisition Act, 1894 for acquisition of large extent of land for the purpose of formation of outer ring road and accordingly an award dated 07.01.2009 has been passed awarding the compensation to the land owners.
Thereafter, questioning the said award, some of the land owners filed writ petition and the same was allowed by this Court holding that the award is vitiated for the reasons mention therein. Against the same, the respondent-HMDA filed Special Leave to Appeal, which is pending. Regarding the petitioner's plots, the respondents have taken over the possession in the month of April 2009. Subsequently, the petitioner made representation dated 13.03.2014 before the 2nd respondent requesting to conduct survey and pay the applicable compensation by enclosing the copies of all necessary documents. Since no action has been initiated by the respondents 2 and 3, the petitioner made representations dated 18.11.2015, 13.12.2015 and 20.05.2016. But no action has been initiated. Aggrieved by the same, the present writ petition is filed.
Heard the learned counsel for the petitioner, learned Assistant Government Pleader for Land Acquisition for 1st respondent and Sri E. Madan Maohan Rao, learned Standing counsel for respondents 2 and 3.
In view of the above facts and circumstances, the respondents are directed to dispose of the representations made by the petitioner on 18.11.2015, 13.12.2015 and 20.05.2016 in accordance with law and thereafter take appropriate action.
With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 27-06-2016 dv
