THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY W.P.M.P. No.36251 of 2016 AND WRIT PETITION No.12852 of 2016 COMMON ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking writ of mandamus declaring the inaction of first respondent in paying a sum of Rs.2,94,69,772/- to the petitioner against the invoices dated 09.12.2015 and 31.12.2015 as illegal and arbitrary.
2. W.P.M.P. No.36251 of 2016 is filed seeking permission to withdraw the writ petition.
3. When the matter came up for hearing, learned counsel for the petitioner seeks permission of this court to permit the petitioner to withdraw the writ petition with liberty to avail all the remedies available to it under law. Permission is granted.
4. Accordingly, the W.P.M.P. No.36251 of 2016 is ordered and consequently the writ petition is dismissed as withdrawn granting liberty as prayed for. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
