THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.10016 OF 2017 ORDER:

Heard the learned counsel for the petitioner and perused the material on record. Notice sent to respondent No.1 is returned unclaimed. Service of notice is held sufficient.

This Criminal Petition is filed under Section 482 Cr.P.C. seeking a direction to the Family Court, Ranga Reddy District to dispose of O.P. No.378 of 2017 and M.C. No.66 of 2017, both pending on its file, together.

O.P. No.378 of 2017 is filed by petitioner herein against respondent No.1, who is his wife, seeking divorce. M.C. No.66 of 2017 is filed by the respondent No.1 herein against the petitioner herein claiming maintenance. It is submitted that similar contentions are raised by the parties in both the above cases and in order to have consistency in the findings, both the cases have to be disposed of by the Court below simultaneously. It is not in dispute that the parties in both the cases are one and the same. For proper appreciation of the evidence and consistency in the decisions, the Court below is directed to record the evidence, and proceed with the adjudication of, both the cases simultaneously, and if possible, pronounce orders on the same day.

With the above direction, the Criminal Petition is disposed of. Miscellaneous Petitions pending, if any, in the Criminal Petition shall stand closed.
