THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2050 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioners/accused Nos.2, 3, 7 and 8 seeking to quash the Crime No.212 of 2013 of Nandyal II Town Police Station, Kurnool District, for the offences under Section 45(5) RBT Act and Sections 420, 120-B I.P.C. and Section 5 of APPDFEA Act.

Heard the learned counsel for the petitioners/accused and the learned Public Prosecutor and perused the material available on record.

Having regard to the facts and circumstances of the case and also in view of the nature of offence alleged against the petitioners, this Court is not inclined to interfere with the proceedings against the petitioners/accused.

However, in view of the submission of the learned counsel for the petitioners that the petitioners/accused are apprehending arrest in view of the pendency of the above crime and also as the accused No.1 already arrested and released on bail,

the police concerned are directed to complete the investigation without arresting the petitioners/accused and file the final report in accordance with law. The petitioners/accused are directed to appear before the Investigating Agency as and when their presence is required, and cooperate with the Investigating Agency.

With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
