This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.125 of 2016 on the file of Additional Judicial First Class Magistrate, Tiruvuru, registered against the petitioners/ A4 and A-5 for the alleged offences punishable under Sections 498_A, 506 IPC and Sections 3 and 4 of the Dowry Prohibition Act. Heard learned counsel for the petitioners and learned Public Prosecutor appearing for the State.
A perusal of the material on record reveals that specific allegations were made against the petitioners. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.
In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the criminal petition is disposed of, directing the trial court to dispose of the case as expeditiously as possible, without insisting the presence of the petitioner Nos.4 and 5/ accused Nos.4 and 5 unless required for any specific purpose. It is needless to observe that petitioners are at liberty to move trial court for appropriate relief under law, including that of petition for discharge.
