THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6271 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 by the petitioner/accused seeking to quash the proceedings in Crime No.63 of 2016 of Bhadrachalam Town Police Station, Khammam District.

2. Heard and perused the material available on record.

3. The offences alleged against the petitioner are punishable under Sections 498-A and 306 I.P.C.

4. Admittedly, the marriage between the petitioner and the deceased by name Kalpana was performed on 18.5.2005. She committed suicide on 11.4.2016. Even in the complaint, it is stated that since three years prior to the death of the deceased, there were quarrels between the petitioner and the deceased. Except that, there are no serious allegations against the petitioner. Considering the said facts and circumstances of the case, the petitioner is directed to appear before the police concerned on or before 10.5.2016 and execute a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum for his future appearance and shall also file an affidavit informing the police to cooperate with the investigation. On such execution of bond and affidavit, the police concerned are directed to complete the investigation and file a final report, if any, without arresting the petitioner.

5. With the above directions, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
