This petition is filed under Section 24 of C.P.C. to withdraw O.S.No.34 of 2012 from the file of the Industrial Tribunal-cumLabour Court and VI Additional District and Sessions Judge at Godavarikhani and transfer the same to the file of the Chief Judge, City Civil Court, Hyderabad.

Heard the learned counsel for both the parties. 3.

A perusal of the record reveals that the first respondent herein filed O.S.No.34 of 2012 against the petitioners/defendant Nos.1 to 4 for recovery of an amount of Rs.157,65,65,000/-. 4.

Learned counsel for the petitioners and the first respondent submitted that the second respondent - Bank is a proforma party. Learned counsel for both the parties with one voice submitted that the transfer petition may be allowed as prayed for. 5.

In view of the submission made by the learned counsel for both the parties, this Court is not inclined to go into the merits of the case.

6. Accordingly, the Transfer Civil Miscellaneous Petition is allowed. O.S.No.34 of 2012 is withdrawn from the file of the Industrial Tribunal-cum-Labour Court and VI Additional District and Sessions Judge at Godavarikhani and transferred to the file of the Chief Judge, City Civil Court, Hyderabad, for disposal in accordance with law. There shall be no order as to costs.
