HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 3 7 9 4 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Krishnalanka Police Station, Vijayawada City, dated 21.12.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that basing on the complaint of the petitioner, a case in Cr.No.167/ 2016, dated 11.03.2016, under Sections 451, 452, 509, 506 354D of I.P.C. was registered on the file of the 3rd respondent Police Station, against one Ravanth and others, wherein investigation was taken up by the Krishnalanka Police.

It is submitted that during the course of investigation, the Investigating Officer has examined six witnesses and recorded their statements and also analyzed the concerned face book account, wherein the alleged offence is prima facie established against Adidela Revanth. Thereon, after completion of investigation, the absconding charge sheet was filed in Cr.No.167/ 2016, against the accused u/ ss.451, 452 509, 506, 354(D) of I.P.C., and Section 66(C), (D), 67 of I.T.Act, before the Hon'ble II-Additional Chief Metropolitan Magistrate Court, Vijayawada, on 18.12.2018, since the accused was absconding since the registration of the above case. The above said charge sheet was acknowledged by the Hon'ble IIAdditional Chief Metropolitan Magistrate Court, Vijayawada, vide CF No.11061/ 2018, wherein CC No. is awaited.

In view of the facts and circumstances stated above, there is no inaction on the part of the respondent Police authorities, as alleged. All other allegations of the petitioner against the respondent Police authorities are incorrect, untenable and hereby denied."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, Krishnalanka Police Station, Vijayawada City, dated 21.12.2018.
