Late Venkataiah Petitioner (Accused in Cr.No.228/2017 of Ieeja P.S., Jogulamba Gadwal Dist) AND The State of Telangana, rep. by its Public Prosecutor, High Court at Hyderabad, through Station House Officer, Ieeja Police Station, Jogulamba Gadwal District, Telangana. Respondent/Complainant Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to enlarge the petitioner on bail in the event of his arrest in FIR.No. 228 of 2017 on the file of Ieeja Police Station, Jogulamba Gadwal District, Telangana.
The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri Allam Ramesh, Advocate for the Petitioner and of the Addl. Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:
" This petition is filed under Section 438 Cr.P.C. to grant anticipatory bail to the petitioner for the offences alleged under Sections 420, 406, 409, 468, 471 and 120 (B) IPC.

Heard learned counsel for the petitioner, learned Additional Public Prosecutor representing the State and perused the record. 3.
Learned counsel for the petitioner would submit that the petitioner is an innocent person and falsely implicated in this case. The petitioner has nothing to do with the mis-appropriation of funds.

On the other hand, learned Additional Public Prosecutor opposed the grant of bail to the petitioner stating that the petitioner has given a false inspection report and ultimately, prayed to dismiss the petition. 5.
As per the material on record, the petitioner has given a report, dated 25.02.2015 on the letter written by one Khaja Hussain, Assistant Engineer, Ieeja Nagar Panchayat, Mahabubnagar District. In the letter several reasons are given by Khaja Hussain, who is A2 in this case stating that the work was held up due to non availability of Technical Engineer and it is pending for long time without inspection. Whether the petitioner is competent to give a report or not would be decided at the time of trial. The petitioner is an Engineer dealing in civil construction work. The petitioner is running M/s S.V.Associates, Kukatpally, Hyderabad. On invitation by A2, the petitioner gave an inspection report. It is for the authorities concerned to act on the report given by him or not. It cannot be said that the petitioner has a hand in glove with the other accused in this case. It is also contended that the petitioner was issued with a notice under Section160/91
(1) Cr.P.C. by the Circle Inspector of Police, Shantinagar, wherein it is stated that to find out the truth of the alleged mis-appropriation/quality control report issued by the petitioner, the presence of the petitioner was required in this case. Under these circumstances, there is apprehension of arrest of the petitioner. 6.
Having regard to the nature of allegations levelled against the petitioner, he can be granted bail under Section 438 Cr.P.C.

In the result, the Criminal Petition is allowed directing the petitioner to surrender before the Station House Officer, Ieeja Police Station, Jogulamba Gadwal District, within 15 days from the date of this order. On such surrender, the said S.H.O. shall release the petitioner on bail, on his executing a personal bond for Rs.10,000/- (Rupees ten thousand only) with two sureties each in a like sum to his satisfaction. On release, the petitioner shall abide by the conditions mentioned under Section 438 (2) Cr.P.C. The petitioner shall co-operate with the Investigating Officer."
