THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.10719 OF 2017 ORDER:

This criminal petition is filed to quash the proceedings in S.C.No.453 of 1993 on the file of III Additional Sessions Judge, Karmnagar, for the offences punishable under Sections148, 452, 307, 324, 506 r/w 149 IPC, Section 25(1)(A) of Indian Arms Act and Sections 3 & 6 of T.A.D.A Act.

The main contention of the learned counsel for the petitioner before this Court is that, though the petitioner is residing in the same area, he was shown as absconding and issued proclamation. Further NBW is also pending against this petitioner and requested this Court to issue necessary direction to the Court below to decide S.C.No.453 of 1993 a an early date, by considering the application, if any, filed by this petitioner under Section 70(2) of Cr.P.C. In view of the specific request made by the learned counsel for the petitioner, since it is a Sessions Case of the year 1993 i.e. more than 24 years, without touching the merits of the case, I deem it appropriate to direct the Sessions Judge to dispose of S.C.No.453 of 1993, as early as possible, in accordance with law, if any application is filed under Section 70(2) Cr.P.C. With the above direction, the criminal petition is disposed of. Consequently, miscellaneous applications pending if any, shall also stand closed. No costs.
