THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT APPEAL NO.1045 OF 2016 JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} The order under appeal is an interlocutory order passed by the learned Single Judge that too in a Writ Petition wherein notice before admission was ordered.

As the Writ Petition itself has not even been admitted, we see no reason to exercise jurisdiction under Clause 15 of the Letters Patent to interfere with the interim order passed by the learned Single Judge. Needless to state that this order shall not preclude the appellant herein from filing counter affidavit along with a petition for vacation of the interim order before the learned Single Judge.

Subject to the above observations, the Writ Appeal fails and is, accordingly, dismissed. There shall be no order as to costs.
