THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2450 of 2016 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/ accused in C.C.No.286 of 2015 pending on the file of VII Special Magistrate, Hyderabad at Erramanzil, arising out of private complaint filed under Section 138 read with Section 142 of Negotiable Instruments Act.
Heard the learned counsel for the petitioner/accused and the learned Public Prosecutor and perused the material available on record.
After arguing for sometime, the learned counsel for the petitioners, while not pressing for the main prayer, confined his argument only to the extent of dispensing with the presence of the petitioners before the trial Court.
In any event, considering the facts and circumstances of the case and also in view of the fact that the identity of the petitioner/ accused is not denied or disputed, the presence of the petitioner/ accused before the trial Court is dispensed with except on the dates when their presence is essentially required by the Court and the petitioners shall be properly represented by his counsel.
With the above observation, this criminal petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
