THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2282 OF 2016 ORDER:

This petition is filed by the petitioner-accused under Section 482 Cr.P.C. challenging the order dated 11.1.2016 passed by the 2nd respondent in Crime No.B2/822/2015 in PCOR No.577 of 2015-16.

It is stated that on 8.11.2015 while the petitioner was transporting the white jaggery of 750 kgs belonging to one Billakanti Satyanarayana, from Makthal to Devarakadra in his Mahindra Mini Auto bearing No.TS 06 UA 7942, the 3rd respondent-Excise police seized the vehicle and filed the above case. When the petitioner filed an application before the 2nd respondent for interim custody of the said vehicle pending enquiry, the 2nd respondent passed the order impugned directing the petitioner to deposit FDR for Rs.1,40,000/- for the release of the vehicle. Aggrieved by the said condition, the petitioner filed this petition. Heard and perused the material available on record. Considering the facts and circumstances of the case, the above condition imposed by the 2nd respondent directing the petitioner to deposit FDR for Rs.1,40,000/-, is modified to that of FDR for Rs.50,000/- (Rupees Fifty Thousand only). Rest of the conditions imposed by the 2nd respondent in the order impugned, shall remain.

Accordingly, the Criminal Petition is disposed of.
