HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 45545 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos. 3 and 4 in proceeding with transferring the saw mill licence No.939 of 2008, existing in the name of the petitioner pertaining to M/ s.Bismilla Saw Mill, situated at Chennamukkapalli village, Rayachoti mandal, YSR Kadapa District to respondent Nos.5 and 6, inspite of the legal notice dated 29.10.2018, issued by the petitioner, as illegal and arbitrary.

2) Though various grounds are raised, learned counsel for the petitioner would submit that the authorities are trying to transfer the saw mill licence of the petitioner in favour of the unofficial respondents, without hearing the petitioner or giving an opportunity to explain his stand.

3) On the other hand, learned Government Pleader would submit that pursuant to an application made, an enquiry is going on and that no licence has been transferred in favour of respondent Nos.4 and 5. He further states that the petitioner can as well participate in the said enquiry basing on his records and thereafter the authorities concerned shall pass orders, in accordance with law.

4) Having regard to the fact that an enquiry is going on, the writ petition is disposed of directing the petitioner to participate

in the said enquiry by submitting his objections, in which event, the authorities shall deal with the same and pass orders, in accordance with law. No costs.

5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
