HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.4428 OF 2016 ORDER:

This writ petition is filed with the following prayer: "....to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 2 and 3 in not providing police protection to the lives and property of the petitioners bearing Sy.No.4, to an extent of Ac.0-12 gts situated at Kothaguda Village, Serlingampally Mandal, Ranga Reddy District, on their report/representation dated 06.12.2015, as illegal, arbitrary, violative of principles of natural justice and also in violation of Articles 14, 19 & 21 of the Constitution of India and consequently direct the respondents 2 and 3 to provide police protection to the lives as well as property of the petitioners, and to pass such other order or orders as the Hon'ble Court may deem fit and proper in the circumstances of the case." This Court granted interim order on 11-02-2016, which reads as follows:

"In the light of the decree of permanent injunction granted in favour of the petitioners by the learned Additional Junior Civil Judge, Cyberabad, Kukatpally at Miyapur, in O.S.No.182 of 2012, there shall be a direction to the third respondent to provide assistance to the petitioners to secure compliance with the said injunction. In this context, it may be noted that such assistance would only be available as against the defendant in the said suit or anyone claiming through him."

Heard both sides.

The main prayer and the interim prayer are one and the same.

Learned counsel for the petitioner also says that the writ petition may be disposed of in terms of interim order. In view of the same, the writ petition is disposed of in terms of interim order, dated 11-02-2016. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
