HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11212 OF 2017 ORDER:

Heard the learned counsel for the petitioner-accused, learned Additional Public Prosecutor and perused the material on record. This Criminal Petition is filed under Section 439(1)(b) Cr.P.C. to relax the condition imposed on the petitioner-accused, vide the order dated 19.04.2017 passed by the Additional Judicial Magistrate of First Class, Shadnagar, in Cr.No.302 of 2016, by reducing the surety amount from Rs.10,000/- with two sureties for the like sum to Rs.5,000/- with one surety.

In the circumstances narrated, the impugned order is modified and the surety amount is reduced from Rs.10,000/- to Rs.5,000/- (Rupees five thousand only), the petitioner shall produce one surety and the surety shall be a blood relative of the petitioner.

With the above modifications, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions, if any pending in this Criminal Petition, shall stand closed.
