ORDER

This petition is filed under Section 482 Cr.P.C., to quash the FIR in Crime No.180 of 2017 of Veenavanka Police Station, Karimnagar District, registered for the offences punishable under Sections 354, 201, 506 read with Section 34 IPC, against the petitioner/A1.

It is alleged in the complaint that on 15.08.2017 at 20.00 hours, at Veenavanka village, A1 came to the house of the victim, by name, Vorem Veeramma, aged 70 years, caught hold of her hands and tried to outrage her modesty and when she made hue and cry, A1 ran away from there and that on 17.08.2017, while the victim and de-facto complainant were proceeding to report the incident to police, A2 to A7 threatened the victim with dire consequences to kill her and arranged a sum of Rs.2,000/-to her and again on 18.08.2017, A2 to A7 took her with them by warning the de-facto complainant.

The main contention of petitioner/A1 is that there are no specific overt acts attributed against the petitioner and the allegations made against him are all false and baseless and that there was delay in lodging the complaint before the police. 4.

Learned Public Prosecutor submits that the matter is under investigation. The petitioner's counsel requested this Court to direct the police concerned to follow the procedure as envisaged under

MSM, J Crl.P.No.9918 of 2017 Section 41-A Cr.P.C., and as held by the Apex Court in Arnesh Kumar v. State of Bihar1.

In view of the request made by the learned counsel for petitioner and having found that there are no grounds to quash the FIR, I deem it appropriate to direct the police concerned to follow the procedure as envisaged under Section 41-A Cr.P.C., and the principles laid down by the Apex Court in Arnesh Kumar's case (1 supra).

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
