HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41745 of 2016 ORDER:
This writ petition is filed seeking to declare the action of the respondents 3 to 5 in harassing the petitioner by interfering into civil disputes and pressurizing the petitioner to pay the debt amounts to respondents 6 to 18, otherwise he will be implicated in criminal cases, as illegal and arbitrary and consequently, direct the respondents 3 to 5 not to harass the petitioner at the instance of the unofficial respondents.
Heard and perused the material available on record. The grievance of the petitioner is that there are civil disputes between him and the respondents 6 to 19 and he obtained a hand loan from the respondents 6 to 19 and repaid 50% of the said amount with interest to them but, due to financial crisis, he could not repay the remaining amount and requested time for repayment of the balance amount. But, the unofficial respondents approached the police officials and at their instance, the police officials are harassing the petitioner by calling him to the police station and pressurizing him to settle the issue with the unofficial respondents.
Learned Assistant Government Pleader for Home submitted that the respondent police are not intending to interfere with the civil disputes.
Considering the circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:
" The respondents 3 to 5 are directed not to interfere with the affairs of the petitioner and the respondents 6 to 19, more particularly, with the civil disputes pending between them. However, this Order will not stand in the way of the respondents 3 to 5 to register a case, if any complaint is lodged against the petitioner for cognizable offence."
There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ______________ RAJA ELANGO, J December 01, 2016 KTL
