This Criminal Petition, under Sections 437 and 439 of the Code of Criminal Procedure, 1973, is filed by the petitioners/ accused Nos.1, 4 and 5, for grant of bail in connection with Crime No.316 of 2017 on the file of the Sircilla Police Station, Rajanna Sircilla District.

Heard the learned counsel for the petitioners/ accused Nos.1, 4 and 5, learned Additional Public Prosecutor representing the respondent-State and perused the record.

The learned counsel for the petitioners/ accused Nos.1, 4 and 5 would submit that investigation is completed. No more witnesses are required to be examined. The petitioners are in jail from 14.08.2017. Therefore, the petitioners are entitled to be released on bail.

On the other hand, the learned Additional Public Prosecutor would submit that earlier bail petition of the petitioners/ accused Nos.1, 4 and 5 was dismissed on 13.10.2017. Investigation is not yet completed. Therefore, the petitioners are not entitled for grant of bail.

As per the material placed on record, grave allegations are made against the petitioners/ accused Nos.1, 4 and 5 for commission of offences punishable under Section 302 read with Section 34 of I.P.C. The investigation is in progress. The earlier bail petition of the petitioners/ accused Nos.1, 4 and 5 was
Dr.SA, J CRL.P.No.10132/2017 dismissed on 13.10.2017 elaborately assigning reasons. Under these circumstances, there is no justification in allowing this Criminal Petition.

In the result, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
