THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5897 of 2016 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings initiated against the petitioner/ accused in C.C.No.1127 of 2014 on the file of XIX Metropolitan Magistrate, Cyberabad, Kukatpally, arising out of Crime No.327 of 2014 of Chandanagar Police Station, Cyberabad, Ranga Reddy District, registered for the offences punishable under Sections 448, 290, 504, 506 and 509 IPC.
Heard and perused the material available on record. A thorough reading of the charge sheet reveals that the petitioner/accused illegally trespassed into the office of the de facto complainant in a rash and negligent manner and ransacked into the office and scolding the boss of the de facto complainant and also the de facto complainant in filthy language and when the de facto complainant tried to defend herself to stop the petitioner/accused, the petitioner/accused bore grudge against her by showing his fist and threatening her to kill mercilessly and tried to caught hold of her hand and by confining her in the office room. Whether the petitioner/accused has committed the alleged offences or not is a matter to be decided by the competent court after a due trial. Since specific allegations are made against the petitioner/accused, this court is of the view of that it is not a fit case to quash the proceedings invoking the jurisdiction under Section 482 Cr.P.C., and hence, the criminal petition is liable to be dismissed.
Accordingly, the Criminal Petition is dismissed.
Consequently, miscellaneous petitions, if any, pending, shall stand closed.
