THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9103 OF 2016 ORDER:

This Criminal Petition is filed by the petitioner/A-1 under Section 439(1)(b) Cr.P.C. seeking to relax the conditions imposed on him on 18.5.2016 in Crl.M.P.No.1537 of 2016 in C.C.No.56 of 2016 by the V Additional Judicial Magistrate of First Class, Kakinada by setting aside the order, dated 7.6.2016, in Crl.M.P.No.1663 of 2016.

2. The offences alleged against the petitioner are punishable under Section 498-A read with 34 I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

3. Heard and perused the material available on record.

Vide order, dated 18.5.2016, in Crl.M.P.No.1537 of 2016, the petitioner was granted bail on certain conditions i.e., to co-operate for investigation and shall not try to tamper witnesses in any manner; to attend before the Station House Officer concerned on every Sunday in between 9:00 A.M. and 12:00 noon till completion of investigation or till filing of charge sheet, whichever is earlier, and file proof of compliance before the Court below; shall not indulge in any acts of threatening L.W.1/victim in any manner and also shall not threaten any of the witnesses in any manner. Praying to relax the said conditions, the petitioner filed Crl.M.P.No.1663 of 2016 and the same was dismissed on 7.6.2016. Hence, the petitioner filed the present Criminal Petition seeking to relax the conditions imposed on him in Crl.M.P.No.1537 of 2016 by setting aside the order, dated 7.6.2016, in Crl.M.P.No.1663 of 2016.

5. Considering the facts and circumstances of the case, the condition imposed on the petitioner on 18.5.2016 in Crl.M.P.No.1537

of 2016 in C.C.No.56 of 2016 on the file of the V Additional Judicial Magistrate of First Class at Kakinada to appear before the Station House Officer concerned on every Sunday in between 9:00 A.M. and 12:00 noon only is relaxed. The other conditions shall remain unaltered.
