BUCHI BABU COUNSEL FOR THE RESPONDENT : THE PUBLIC PROSECUTOR (TG) Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to grant anticipatory bail to the Petitioners/Accused No.3 in the event of his arrest in Connection with Crime No. 363 of 2017 of P.S. Karimnagar-I Town, under Sec.420, 406, 506, R/w.34 of IPC. The Court made the following Order:

Heard learned counsel for the petitioner/A.3, learned Additional Public Prosecutor for the respondent State and perused the record.

This petition is filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner/A.3 in Crime No.363 of 2017 of Karimnagar-I Town Police Station, Karimnagar District, for the offences punishable under Sections 420, 406 and 506 read with Section 34 IPC.

It appears from the record that there are money transactions between the de facto complainant and A.1. The land of de facto complainant in an extent of Ac.1.00 guntas in Sy.No.520 of Thimmapur Mandal got registered by A.1 in the name of A.2.

It is alleged that the de facto complainant paid the due amount to A.1. On receipt of due amount by A.1, the A.2 has not register the subject land in faovur of defaco complainant. It is alleged that the petitioner and others threatened the de facto complainant. The dispute between the parties appears to be a monitory dispute, civil in nature. Having regard to the nature of allegations and apprehension of the petitioner for his arrest, the petitioner can be enlarged on bail.

In the result, the Criminal Petition is allowed directing the petitioner/A.3 to surrender before the Station House Officer, Karimnagar-I Town Police Station, Karimnagar District, within 15 days from the date of this order. On such surrender, the said Station House Officer shall enlarge the petitioner/A.3 on bail on executing a personal bond of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to his satisfaction. On such release, the petitioner/A.3 shall abide by the conditions mentioned in Section 438(2) Cr.P.C.
