HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.43819 of 2018 ORDER:

This Writ Petition is filed seeking writ of mandamus declaring the proceedings in Rc.No.124/2017A, date 28.12.2017 and the order dated 28.12.2017 directing the Village Revenue Officer, Sancham to take over the above said resumed land issued by the 4th respondent, as illegal and arbitrary. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondents.

Learned counsel for the petitioner that the 4th respondent issued impugned proceedings dated 28.12.2017 canceling the patta granted in favour of the petitioner in respect of Ac.1.29 cents in Sy.No.236-3, Sancham Village, without any notice. Learned Assistant Government Pleader for Revenue appearing for respondents submits that the impugned proceedings goes to show that notice was issued, but however, submits that the petitioner has an alternative remedy of appeal before the Revenue Divisional Officer.

Since it is asserted by the learned counsel for the petitioner that the impugned proceedings are issued recently, it is open for the petitioner to avail alternate remedy of appeal against the impugned proceedings, within a period of four weeks from today. Till then, status quo with regard to possession, as on today, shall be maintained.

With the above direction, this Writ Petition is disposed of. Miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
