No proof of service of the notice sent to 2nd respondent filed pursuant to the order to take notice before admission. Heard and perused the record. It is premature to express any opinion as to which of the offences that attract the facts if any but for to allow the investigation to go on. Having regard to the above, the Criminal Petition is disposed of directing the police to investigate the case but to strictly follow Section 41-A of CrPC, and also the guidelines in Arnesh Kumar Vs. State of Bihar1, if at all any arrest of the petitioner/A.1 is required, as none of the offences alleged are with the punishment of above 7 years. Pending miscellaneous petitions, if any, shall stand closed.
