ORDER:

The petitioner, which is a family restaurant being run in an area which is allegedly earmarked for parking, filed this Writ Petition feeling aggrieved by show cause notice, dated 30.12.2015, issued by respondent No.2. Mr. Chandra Sekhar Ilapakurti, learned counsel for the petitioner, has not disputed the fact that the impugned proceedings are merely in the nature of a show cause notice and that no order adverse to his client's interests has been passed so far. He has further submitted that

the petitioner has already submitted its explanation to the show cause notice and that on apprehension that before passing an order on the show cause notice, respondent No.2 may remove the construction, the present Writ Petition is filed.

Mr. Ancha Pandu Ranga Rao, learned Standing Counsel for Rajahmundry Municipal Corporation, submitted that his client will not take further action until a final order on the show cause notice is passed and communicated to the petitioner.

In the light of the above facts and the submission of the learned Standing Counsel, no further adjudication of the Writ Petition is necessary and the same is, accordingly, disposed of.

As a sequel to disposal of the Writ Petition, W.P.M.P.No.258 of 2016 shall stand disposed of as infructuous.
