This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in Domestic Violence Complaint No. 9 of 2016 on the file II Additional Chief Metropolitan Magistrate at Visakhapatnam, registered against the petitioners.
Heard the learned counsel for the petitioners and the learned Public Prosecutor appearing for the State.
A perusal of the material on record reveals that specific allegations were made against the petitioners. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.
In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the criminal petition is disposed of, directing the trial court to dispose of the case as expeditiously as possible, without insisting upon the presence of petitioners 2 to 7, unless required for any specific purpose during the course of trial.
