HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 6214 of 2016 ORDER:

Against the orders of 4th respondent in Rc.B.4851/2010 dated 16.04.2015, the petitioner filed a revision on 17.02.2016 along with a stay petition and it is stated to be pending with the 2nd respondent. The grievance of the petitioner is that as the revision is not yet taken up for hearing, the 4th respondent is trying to execute the order passed by the 3rd respondent, pending the revision. The petitioner, therefore, seeks hearing and disposal of the revision.

Heard learned counsel for the petitioner and learned Government Pleader for revenue appearing for respondent Nos.1 to 4.

In view of the fact that the petitioner's revision along with the stay petition is stated to be pending before the 2nd respondent since 17.02.2016, I deem it appropriate to direct the 2nd respondent to fix an early date, after notice to the petitioner, and decide the stay petition at least within a week from the date of receipt of a copy of this order.

The 4th respondent shall maintain status-quo, till appropriate orders are passed by the 2nd respondent. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand dismissed. ___________________________ VILAS V. AFZULPURKAR, J 26th February, 2016 Note: Furnish C.C. in three days.
