The learned counsel for the appellants would submit that since the subject suit in O.S.No.159 of 2007 on the file of the I Additional Senior Civil Judge, Mahaboobnagar, was dismissed as withdrawn, nothing survives for adjudication in this appeal, which is filed challenging interlocutory order passed in the said suit.

Recording the said submission, the appeal is dismissed as infructuous. No costs.

Miscellaneous petitions, if any, pending in this appeal, shall stand closed.
