THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.19198 of 2016 ORDER:

The petitioner was appointed as conductor in the corporation in the year 2005. While so, on 29.03.2016 when he was conducting bus bearing registration No.AP 28Z 4412 from Banswada to Bodhan, a check was conducted at Stage No.13 i.e., Durky and a cash & ticket irregularity was noticed. The petitioner was placed under suspension by proceedings dated 11.04.2016 and a charge sheet was also issued. The petitioner submitted his explanation to the charge sheet on 19.04.2016 and the enquiry was also completed. Learned counsel for the petitioner submits that the passenger was not examined and he delivered a copy of the statement made by the passenger, which was filed along with the writ petition, wherein the passenger retracted the statement made before the Inspector. Since the order of suspension was passed on 11.04.2016, this Court is not inclined to interfere with the said order. Now, it is clear that the enquiry is also completed.

In view of the above, this Writ Petition is disposed of directing the respondent No.3 to consider the statement, alleged to have been made by the passenger and produced along with the papers filed in the writ petition, at the time of passing final orders, pursuant to the enquiry report submitted to him, within a period of four (4) weeks from the date of receipt of a copy of this order.
