The petitioners have preferred a revision along with stay petition on 26-11-2015 before the 2nd respondent under Section 9 of the A.P.Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act'). The said revision along with stay petition is stated to have been filed by sending it through registered post with acknowledgment due, which is acknowledged by the office of the 2nd respondent on 06-01-2016.

The grievance of the petitioners is that the said revision petition is not being entertained by the 2nd respondent and it is neither numbered nor any date of hearing is fixed.

Heard the learned Government Pleader for Revenue, who states that the Joint Collector is relegated with the powers under Section 9 of the Act and the petitioners have not filed any revision before the Joint Collector.

It is, however, to be seen from the record that the office of the 2nd respondent has acknowledged the revision petition along with stay petition. Hence, if the same appears to have been received by the 2nd respondent, who has to either deal with the same by himself or make it over to the Joint Collector concerned so as to deal with the said revision petition on merits, the Collector or the Joint Collector as the case may be shall, therefore, fix an early date of hearing of the said revision petition and the stay petition, if the revision is found to be otherwise in order and then fix a date of hearing after notice to the petitioners and then take up and pass appropriate orders atleast on the

stay petition preferably within two weeks from the date of receipt of a copy of this order. No costs.
