HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.43121 OF 2016 ORDER:

This writ petition is filed declaring the action of the 3rd respondent in issuing notification dated 05.05.2016 which was published in Andhra Jyothi Daily Newspaper on 05.05.2016 that certain survey numbers bearing R.S.Nos.152/1A2B1, 152/5A, 152/8A, 152/1A, 152/1A2B1 and 152/1G admeasuring an extent of 71.63, 40.50, 65.00, 2.50, 41.85 and 138.14 sq.meters respectively belongs to the petitioners herein situated at Madhavaipalem Village, Narsapuram Mandal, West Godavari District without following due process of law, as illegal and arbitrary.

Learned counsel for the petitioners submit that the petitioners have already filed objections in pursuance to the notification issued on 05.05.2016 and states that the direction given by this Court in W.P.No.37448 of 2016 is sufficient for redressing the grievance of the petitioners in the present case. Sri S.S.Varma, learned Standing counsel appearing for respondent 1 and 2 submits that the writ petition can be disposed of interms of the order dated 02.11.2016 in W.P.No.37448of 2016. Heard the learned Assistant Government Pleader for 3rd respondent.

In view of the above, the 3rd respondent is directed to consider the objections filed by the petitioners on 09.05.2016 and pass appropriate orders in accordance with law within a period of eight (08) weeks from the date of receipt of copy of this order.

With the above direction, the writ petition is disposed of. No costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 14-12-2016 dv
