THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.41165 OF 2016 ORDER:

The petitioner alleges that the 3rd respondent made unauthorised construction in Survey No.921 situated in Ward No.6, Railway Station Road, Rajampet, Y.S.R. Kadapa District, which is located adjacent to his property. The grievance of the petitioner is that in spite of making complaints to the respondent - Municipality, no decision is taken to stop the alleged illegal construction and to ensure that the 3rd respondent has not violated the building permission granted to him. 2.

Today, when the matter is taken up for consideration, learned Standing Counsel for the respondent - Municipality, produced the proceedings of the respondent - Municipality, dated 28.11.2016, addressed to the 3rd respondent calling upon him to show cause as to why further action should not be taken. 3.

The Writ Petition is disposed of based on the submission of learned Standing Counsel that the respondent - Municipality has issued proceedings, dated 28.11.2016 to the 3rd respondent calling for his explanation. All the defences available to the 3rd respondent are kept open to be agitated in appropriate proceedings. However, it is open to the petitioner to ventilate his grievance, if no further action is taken by the respondent - Municipality. It is made clear that there is no expression of opinion on merits. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
