THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.S.K.JAISWAL Writ Appeal No.2004 of 2017 JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} This appeal, under Clause 15 of the Letters Patent, is preferred against the order passed by the Learned Single Judge in W.P.No.27700 of 2017 dated 15.09.2017 whereby the appellant herein (2nd respondent in the writ petition) was directed to permit the writ petitioner-colleges to admit the students subject to adherence of the conditions laid down with respect to fees and other requirements.

We had, in our order dated 22.01.2018, recorded the submission of Sri N.Sri Ram Murthy, learned counsel for the appellant that, out of 41 applicants, a few colleges were alone found eligible and recommended by the scrutiny committee; it was not the respondent-writ petitioners alone who were recommended; and he would file a detailed affidavit in this regard within a week. We had, therefore, directed the matter to be listed today i.e 31.01.2018.

Sri N.Sri Ram Murthy, learned counsel for the appellant, would submit that, instead of adjudicating the appeal on its merits, it would suffice, in view of passage of time, to modify the order of the Learned Single Judge; and, instead of permitting the respondent-writ petitioners to admit students for the academic year 2017-18, they be permitted to do so for the academic year 2018-19, as the appellant is ready to accord them affiliation for the academic year 2018-19. Sri V.R.Reddy Kovvuri, learned counsel for the respondent-writ petitioners, readily agrees for such an order to be passed.

As both the learned counsel are in agreement, it is wholly unnecessary for us to dwell on the merits of the case any further. Suffice it, therefore to dispose of the appeal modifying the order of the Learned

Single Judge to the limited extent that the order under appeal shall, instead of 2017-2018, apply for the academic year 2018-19. The Writ Appeal is disposed of accordingly. Miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
