BHATT W.P.No. 15826 of 2016 O R D E R:- The petitioners, apprehending forcible dispossession from agricultural lands in Sy.No. 1337/ 2A for an extent of Ac.1.25, Sy.No. 1337/ 2B for an extent of Ac.1.50, Sy.No. 1337/ 2C for an extent of Ac.0.25, Sy.No. 1337/ 2D for an extent of Ac.1.50, Sy.No. 1337/ 2E for an extent of Ac.0.80, Sy.No. 1337/ 2F for an extent of Ac.0.50, Sy.No. 1337/ 2G for an extent of Ac.0.40, Sy.No. 1337/ 2H for an extent of Ac.0.30, Sy.No. 1337/ 2I for an extent of Ac.0.50, Sy.No. 1337/ 2K for an extent of Ac.0.50, Sy.No. 1337/ 2L for an extent of Ac.0.40, Sy.No. 547/ 2 for an extent of Ac.1.30 and Sy.No. 547/ 2 for an extent of Ac.0.50 situated in Ampolu village, Gara Mandal, Srikakulam District, filed the instant writ petition.
The petitioners rely upon D-Form pattas said to have been issued in their favour and contend that they are in actual and physical possession of the property.
The learned Assistant Government Pleader for Revenue, based on written instructions dated 16.09.2016, submits that Sy.No. 547/ 2 covers an extent of Ac.69.24 cents and the respondents are implementing Neeru-Chettu Programme restoring the utility of the tank and reserve the water levels in
SVB,J WP_15826_2016 the locality. Either on pattas or on the possession of the petitioners' the instructions do not refer to anything. Hence, this Court is of the view that the petitioners can be given liberty to file a representation along with photocopies of the pattas the petitioners are relying upon and also enclose a copy of this order before the Tahsildar, Gara Mandal, Srikakulam District for looking into the grievances of the petitioners vis-à-vis the subject matter of the writ petition. The 3rd respondent - Tahsildar is directed to enquire into all aspects of the matter while implementing NeeruChettu Programme and pass appropriate orders on the representation of the petitioners.
With the above observation, the writ petition is disposed of. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
