THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.11401 of 2016 ORDER:
The prayer of the petitioners in this case is as under: "For the reasons stated in the accompanying affidavit the petitioner herein pray that the Hon'ble Court may be pleased to issue a Writ of Mandamus or any other appropriate Writ Order or direction declaring the inaction on the part of the respondent No.2 in not considering the application of the petitioner dated 23-03-2015 to repatriate the Teaching and Non-Teaching staff of the second petitioner college back to enable the petitioners to run the 2nd petitioner college efficiently and seeking a consequential direction to the respondent to repatriate the Teaching and Non-Teaching staff of the second petitioner college back forthwith and to pass such other orders as deem fit and proper in the facts and circumstances of the case."
The second petitioner college's application dated 23.03.2015 made to the Commissioner of Collegiate Education, Andhra Pradesh, Hyderabad, is still awaiting consideration.
As the authority concerned is yet to apply its mind to the said application of the second petitioner college, this Court sees no reason to entertain this writ petition for adjudication on merits at this stage. The writ petition is accordingly disposed of directing the Commissioner of Collegiate Education, Andhra Pradesh, Hyderabad, the second respondent, to consider the second petitioner college's application dated 23.03.2015, give it due opportunity of personal hearing and take an appropriate decision in the matter in accordance with law. In the event the second petitioner college's request for repatriation of teachers is rejected, the Commissioner shall indicate the reasons therefor and duly intimate the same to the second petitioner college. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a
copy of this order.
