THE HONOURABLE SRI JUSTICE RAJA ELANGO TRANSFER CRIMINAL PETITION No.57 OF 2016 ORDER:

This petition is filed by the petitioner under Section 407 Cr.P.C. seeking transfer of C.C.No.1 of 2011 and M.C.No.10 of 2005 pending on the file of the Judicial Magistrate of First Class, Allagadda, to any Court of Magistrate in Kurnool Town.

Heard and perused the material available on record. Except the ground that the petitioner is a resident of Adoni, the other grounds raised by the petitioner in the affidavit for seeking transfer do not disclose any necessity for transferring the cases. The said ground raised by the petitioner that he is a resident of Adoni, is also not enough to transfer the cases. Therefore, this Court is not inclined to grant the relief sought by the petitioner. Accordingly, the Transfer Criminal Petition is dismissed. However, the presence of the petitioner before the trial Court in the above two cases is dispensed with except on the dates when his presence is specifically insisted by the trial Court. The petitioner is directed to be represented through his Counsel on all hearing dates in the above C.C. and M.C. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
