THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1936 OF 2016 ORDER:

This Criminal Petition is filed by the accused under Section 482 of Cr.P.C. seeking to quash the proceedings in C.C.No.54 of 2016 pending on the file of I Additional Judicial First Class Magistrate at Bheemavaram for the offence under Section 309 IPC.

Heard and perused the material on record.

The allegation against the petitioner is that on 23.11.2015 she consumed Alprex-D tablets in order to commit suicide. The entire reading of the evidence collected during the course of investigation reveals that the petitioner herein has consumed the sleeping tablets inadvertently, above the required dose. The said act of the petitioner does not attract the offence under Section 309 IPC and hence the impugned proceedings are liable to be quashed.

The Criminal Petition is accordingly allowed and the proceedings in C.C.No.54 of 2016 pending on the file of I Additional Judicial First Class Magistrate at Bheemavaram are hereby quashed as against the petitioner herein. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
