SMT JUSTICE T.RAJANI CRIMINAL PETITION No.12966 OF 2018 ORDER:
This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.6, in Crime No.405 of 2018 on the file of the Station House Officer, Mahaboobnagar (R) Police Station, Mahaboobnagar District.. 2.
The offences alleged are under Sections 363 and 324 read with 34 IPC and Section 3 (1) (r) (s) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 2015 (for short, 'the Act') .

Heard learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record.

The allegation against the petitioner, as per the complaint, is that this petitioner, along with other accused, kidnapped and voluntarily caused hurt to the son of the de facto complainant, who belongs to a scheduled caste community. Hence, the relief of anticipatory bail cannot be granted, as prima facie the allegations are attracted by the Act.

Hence, considering the above, this Court opines that this is not a fit case for grant of anticipatory bail to the petitioner/accused No.6. However, the petitioner/accused No.6 is at liberty to surrender before the Sessions Court concerned and obtain regular bail. The Sessions Court shall dispose of the bail
application expeditiously, preferably on the same day, on merits, subject to pressure of other work.

Accordingly, with the above observation, the Criminal Petition is dismissed.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
