HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.26664 of 2016 ORDER:

1 This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction on the part of the 2nd respondent in initiating lease proposals of the fishery rights in respect of the tanks situated in Inturu Gram Panchayat as illegal and arbitrary. 2 Heard the learned counsel for the petitioner and the learned Government Pleader for Panchayat Raj & Rural Development (A.P) and the Standing Counsel for the panchayat.

3 A perusal of the record reveals that the petitioner Society was registered under the provisions of A.P. Co-Operative Societies Act. The area of operation of the petitioner society extends to the tanks situated in Inturu village, Guntur district.

4 At the time of arguments, the learned counsel for the petitioner submitted that the petitioner submitted a representation to the 2nd respondent stating that they are ready to pay the lease amount as fixed by the competent authority. For one reason or the other, the 2nd respondent has not disposed of the representation of the petitioner.

5 At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the 2nd respondent to dispose of the representation of the petitioner Society.

6 Having regard to the facts and circumstances of the case, the 2nd respondent is hereby directed to dispose of the representation of the petitioner in the light of G.O.Ms.No.343, Panchayat Raj (SAH.1) Department dated 10.04.1978 as expeditiously as possible, preferably, within a period of two weeks from the date of receipt of a copy of this order. 7 With the above direction, this writ petition is disposed of No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
