THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 472 OF 2016 O R D E R:

This contempt case is filed alleging non-implementation of the order, dated 22.02.2016, passed by this Court in W.P.No.37703 of 2015.

Learned counsel for the petitioner alleges that the respondents have resorted to further demolition of the portion of the house in question in order to construct a drainage channel. In the counter-affidavit, respondent No.1 categorically denied that the Gram Panchayat had taken up demolition work after passing the aforesaid order. He stated that the Gram Panchayat is not a party to the writ petition, as such, there is no order against it.

It is to be noted that the petitioner has filed neither reply affidavit denying the allegations mentioned in the counter-affidavit nor any material in proof of the aforesaid allegation. When the same is pointed out, learned counsel for the petitioner seeks to grant liberty to the petitioner to avail appropriate remedy if the respondents commit any violation of the orders of this Court in future.

In those circumstances, the contempt case is closed with the liberty, as prayed for, subject to maintainability and limitation. Consequently, miscellaneous applications, if any shall
