HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 43976 of 2018 ORDER:

1) Heard learned counsel for the petitioners and Sri V.Narasimha Goud, learned Standing Counsel for Hyderabad Metropolitan Development Authority. 2) The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the inaction of the respondents in granting the final layout permission to the proposed project of the petitioners situated at Survey No.241, Bowrampet village, Quthbullapur mandal, Ranga Reddy District, admeasuring Acs.7.30 guntas, even after the petitioners have duly complied with all the conditions laid out in the provisional permission vide letter dated 02.04.2018, as illegal and arbitrary.

3) Though various grounds are raised, the learned counsel for the petitioners would submit that pursuant to the show cause notice dated 24.10.2018, the petitioners herein submitted their explanation on 29.10.2018 and again on 15.11.2018, but till date no orders are passed. He submits that the inaction of the respondents in proceeding further to the explanation submitted by the petitioners is getting delayed.

4) On the other hand, learned Standing Counsel would submit that if reasonable time is given, the authorities concerned shall pass orders in accordance with law. 5) Having regard to the above, the Writ Petition is disposed of directing the second respondent to pass appropriate orders either on the explanation dated 29.10.2018 or 15.11.2018, given by the petitioners, to the show cause notice dated 24.10.2018, in accordance with law, as early as possible, preferably within a period of two to four weeks from the date of receipt of a copy of this order.
